Determine Eligibility for the Waiver

The applicant must confirm their eligibility to apply for a provisional waiver of inadmissibility. Common grounds for seeking a waiver include unlawful presence or specific grounds of inadmissibility. Eligibility generally requires the applicant to have a qualifying relative, such as a spouse or parent, who would experience extreme hardship if the waiver is not granted.

File Form I-601A

The applicant submits Form I-601A, Application for Provisional Unlawful Presence Waiver, along with the required filing fee and supporting documentation. The supporting documents must include evidence of the qualifying relative's citizenship or permanent residency, proof of relationship, and detailed evidence of potential hardship.

Provide Biometrics

After submitting the waiver application, the applicant must attend a biometrics appointment at an authorized center. During the appointment, fingerprints, a photograph, and a signature are collected for background and security checks.

Wait for the Waiver Decision

The immigration authority reviews the application, supporting evidence, and biometrics results. If the waiver is approved, the applicant can proceed with the consular processing phase of their immigration case. If denied, the applicant receives a written explanation, and they may appeal or file a new application.

Attend Consular Interview

Once the waiver is approved, the applicant proceeds with their immigrant visa application by attending an interview at the consulate or embassy. The consular officer reviews the case, including the waiver approval, to determine if the applicant meets all other requirements for the visa.

Receive Decision and Continue Immigration Process

If the immigrant visa is approved after the interview, the applicant is issued a visa and can travel. Upon arrival, they complete the final immigration process and become authorized to enter. If additional issues arise, further instructions are provided to resolve them.
